Terms of Service

Fortress provides remote monitoring of construction projects. Field agents conduct site visits and submit reports, checklists, and photos so that clients can track project progress. Fortress facilitates the delivery of this information but does not itself perform construction work, and we do not guarantee the accuracy or completeness of any third-party construction activity.

You must be at least 18 years old and able to enter into a binding agreement to use the Service. You are responsible for the activity that occurs under your account and for keeping your sign-in credentials secure. You agree to provide accurate information and to keep it up to date.

Certain features require a paid subscription. Subscription fees, billing cycles, and what each plan includes are described at the point of purchase. Payments are processed by our payment provider, Stripe. By subscribing, you authorise us (through Stripe) to charge the applicable fees. Unless stated otherwise or required by law, fees are non-refundable. We may change pricing on a prospective basis with reasonable notice.

You agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Upload content that is false, misleading, infringing, or that you do not have the right to share.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, copy, or resell any part of the Service except as permitted by law.

You retain ownership of the information and content you submit (such as project details). You grant Fortress a licence to host, store, process, and display that content as needed to operate and improve the Service. Reports, photos, and checklists generated through the Service are made available to the relevant project participants. All software, designs, and trademarks that make up the Service remain the property of Fortress and its licensors.

The Service relies on third-party providers, including Google Firebase and Stripe. Your use of the Service may also be subject to those providers’ terms. We are not responsible for the acts or omissions of third-party providers.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, Fortress and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may stop using the Service at any time and may request account deletion by contacting us. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Nigeria.

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and, where appropriate, notify you within the Service. Your continued use of the Service after changes take effect means you accept the updated Terms.
